Please review these Terms & Conditions carefully. They apply to the Cropwatch Africa mobile application and the associated cloud-based portal (collectively referred to as the "App"). This version supersedes all prior versions. We reserve the right to modify these Terms & Conditions at any time. If changes are made, you will be prompted to accept the updated Terms & Conditions the next time you access the App.
In these Terms & Conditions, "BIOSYNTRIX," "we," "us," and "our" refer to BIOSYNTRIX, PO Box 211, Komatipoort, Mpumalanga, South Africa, and its affiliates.
1. Overview of the App
The App includes a mobile application for data collection and a cloud-based portal for the display and analysis of collected data. The App is intended for use by the Public, Government, Farmers, Researchers, and Industry, including input suppliers, to report and analyze pest, disease, and other crop-related issues in real-time.
2. Acceptance of Terms
By using the App, you agree to comply with (1) these Terms & Conditions, and (2) any applicable terms and conditions from Google, Apple, or other third-party providers. There is no partnership, consortium, or joint liability between BIOSYNTRIX and Google, Apple, or any third-party provider.
3. Changes to the App and Terms
BIOSYNTRIX reserves the right to modify the App, including its features and functionality, and these Terms & Conditions at any time. BIOSYNTRIX will not be liable for any consequences of such changes. Personal data privacy is governed by the BIOSYNTRIX Privacy Statement, available at https://www.biosyntrix.co.za/privacy.
4. Usernames, Passwords, and Security
Your username and password for the App are for your personal use only and must be kept confidential. You are responsible for all activity that occurs under your account. If others need access, they should create their own accounts.
5. Updating User Information
Notify BIOSYNTRIX promptly of any changes to the information provided during registration. We will rely on the most recent information you provide until updated. BIOSYNTRIX may communicate important notices via the email address you provided.
6. Third-Party Content
The App may include content from third parties. BIOSYNTRIX does not guarantee the accuracy, completeness, or reliability of such third-party content and is not responsible for any use made of it.
7. Product and Service Information
Information provided about BIOSYNTRIX products and services is for introductory purposes only. For specific advice, contact us directly. For guidance on crop protection products based on sighting data, consult your National NPPO or Extension officer.
8. Proprietary Rights
The App, including all trademarks and content, is the property of BIOSYNTRIX and is protected by intellectual property laws. You may not reproduce or use any trademark or content except as expressly permitted. The App includes proprietary algorithms, software, and design elements.
9. License to Use the App
You are granted a non-exclusive, non-transferable license to use the App for its intended purposes. You may not modify, distribute, or sell the App or its content. Any third-party access should be through their own App downloads.
10. Data Submission and License Grant
By submitting data through the App, you grant BIOSYNTRIX a non-exclusive, worldwide license to use this data (in anonymized form) for any purpose, including development of new products and services. This license is perpetual, royalty-free, and transferable to relevant NPPO offices.
11. Restrictions on Use
You must comply with applicable laws and refrain from using automated systems to access the App or alter its functionality. Reverse engineering or decompiling the App is prohibited.
12. Disclaimer of Warranties
The App is provided "as is" and "as available." BIOSYNTRIX makes no guarantees regarding the App's availability, functionality, or security. We disclaim all warranties, including those related to merchantability, fitness for a particular purpose, and accuracy of content.
13. Limitation of Liability
To the fullest extent permitted by law, BIOSYNTRIX and its affiliates are not liable for any damages arising from your use or inability to use the App, including any errors or omissions.
14. Governing Law
These Terms & Conditions are governed by the laws of South Africa. Any disputes arising will be resolved exclusively by the courts of South Africa.
